1.1 You will be able to access most areas of this Website without registering your details with us. Certain areas of this Website are only open to you if you register.
1.2 We may revise these terms and conditions at any time by updating this posting. You should check this Website from time to time to review the then current terms and conditions, because they are binding on you. Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages of this Website. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this Website.
2. ORDERING FROM US
2.1 You can place an order with us by ordering via our online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the products or events you have ordered or booked on.
2.2 Our acceptance of your place at an event takes place when we confirm your place in writing. When we confirm your place in writing, the purchase contract will be made even if your payment has been processed immediately, unless we have notified you that we do not accept your order, or you have cancelled your order before we have confirmed your place.
2.3 We may refuse to accept an order:
(a) where a place or goods are not available;
(b) where we cannot obtain authorisation for your payment;
(c) if there has been a pricing or product description error;
(d) if you have previously been in breach of our copyright terms and conditions;
(e) if you do not meet any eligibility criteria set out in our terms and conditions.
2.4 Any discounts or promotional offers run by Deliciously Raw or any third party are not able to be retrospectively applied to existing orders and are subject to availability and may be withdrawn at any time.
2.5 To attend an event, unaccompanied students must be at least 16. Students must be over the age of 13 and if under the age of 16, must be accompanied by a paying adult.
3.1 We are not registered for VAT.
3.2 Where we charge separately for insurance and/or postage and packaging or other relevant charges, the appropriate rates are set out in our specified pricing structure shown at the point of order or checkout where applicable. Otherwise, where we charge separately for optional supplementary products, ingredients, equipment or chef kit, the appropriate rates are set out in our specified pricing structure shown elsewhere on this Website or on the linked events pages or will be agreed before your booking.
4. CANCELLATION AND REFUND POLICY
4.1 If you wish to cancel your place at an event
(a) you can notify us by email to firstname.lastname@example.org after booking and before we have confirmed your place for a full refund.
(b) where we have already confirmed your place, amendments to bookings for one day, two day, half day and evening classes may be made up to 28 days prior to the date of the class and for five day and longer courses, 60 days prior to the start of the course. If you find you are unable to attend a class less than 28 days (60 days for longer 5 day classes) before the date of the event you are welcome to send someone else in your place. We regret that the course fees will only be refunded if we are able to fill your place. For longer course bookings we suggest taking out travel insurance in case you need to cancel at short notice.
4.2 If through unavoidable circumstances Deliciously Raw has to cancel a live event, all course fees will be refunded in full or if you wish, transferred to another course or event. We will not refund any other costs you may have incurred in advance, such as travel and accommodation.
4.3 Since all online programmes, materials and downloads are non-tangible irrevocable products, we do not issue a refund once you have been given access to the online materials. The right to cancel your participation in the online programmes or downloadable content ends once you have been granted access to the online product. By accessing this information, you will have utilised our services and your right to cancel will have ended. If you require technical support to access the programme, please email email@example.com.
4.4 You can return physical goods you have ordered from us for any reason at any time within 14 days of receipt for a full refund or exchange. The costs of returning goods to us shall be borne by you, unless agreed in writing beforehand.
4.5 Upon receipt of the goods we will give you a full refund of the amount paid for the product itself or an exchange credit as required.
4.6 The rights to return the goods to us as referred to in clause 4.4 will not apply in the following circumstances: – in the event that the product has been used in the case of audio or visual products, where the packaging has been unsealed.
The provisions of this clause 4.6 do not affect your statutory rights.
5.1 You are permitted to print and download materials from this Website for your own use on the following basis:
(a) no documents, templates, related graphics or photography on this Website are modified in any way;
(b) no graphics or photography on this Website are used separately from accompanying text; and
(c) any of our copyright and trade mark notices and this permission notice appear in all copies.
(d) No part of any materials may be copied, reproduced, shared, resold, published or transmitted in any form, or by any means (electronic, mechanical, photocopying, photographing, recording or otherwise), for commercial or non-commercial use without the prior written permission of the copyright owner, Deborah Durrant trading as Deliciously Raw or Deborah Durrant.
5.2 Unless otherwise stated, the copyright and other intellectual property rights in all material on this Website (including without limitation photographs, video and graphical images) are owned by us or our licensors. For the purposes of these terms and conditions, any use of extracts from this Website other than in accordance with clause 5.1 above for any purpose is prohibited. If you breach any of the terms in these terms and conditions, your permission to use this Website automatically terminates and you must immediately destroy any downloaded or printed extracts from this Website.
5.3 Subject to clause 5.1, no part of this Website may be reproduced or stored in any other website or included in any public or private electronic retrieval system or service without our prior written permission.
5.4 No part of this Website, our recipes and guidelines, chef’s pro tips, menus, programmes, courses and downloads made be subject to shared access via a single order or subscription.
5.5 Any rights not expressly granted in these terms are reserved.
5.6 Any person found to be in infringement of this licencing agreement may be excluded from Deliciously Raw’s mailing list, events and programmes.
6. SERVICE ACCESS
6.1 While we endeavour to ensure that this Website is normally available 24 hours a day, we will not be liable if for any reason this Website is unavailable at any time or for any period.
6.2 Access to this Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.
7. VISITOR MATERIAL AND CONDUCT
7.2 We would like to promote student’s work via their photographs and therefore photos of courses and events may be shared on social media, used on our website and in advertising. No personal details will ever be published with the photographs unless we have the student’s permission to credit them. Those who do not wish to let us use their photographs or those who do not wish to be photographed need to let us know in advance and are responsible for removing themselves from any group photos.
7.3 You are prohibited from posting or transmitting to or from this Website any material:
(a) that is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience;
(b) for which you have not obtained all necessary licences and/or approvals;
(c) which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party, in the UK or any other country in the world; or
(d) which is technically harmful (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data).
7.4 You may not misuse the Website (including, without limitation, by hacking).

8.3 You shall fully indemnify us for any loss or damage we or any of our group companies may suffer or incur as a result of your breach of clause 8.2.

9.2 Each registration is for a single user only. We do not permit you to share your user name and password with any other person nor with multiple users on a network.
9.3 Responsibility for the security of any passwords issued rests with you and if you know or suspect that someone else knows your password, you should contact us immediately.
9.4 We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these terms and conditions.
10.1 If you are attending an event or live class and have an allergy or food intolerance, it is your responsibility to tell us in advance. Our Kitchen is 100% plant-based, but is not gluten free or nut free. Raw honey is occasionally available onsite.
10.2 If you are taking part in online programmes or following recipes and have an allergy or food intolerance to a food or ingredient recommended, it is your responsibility not to handle or consume that ingredient.
10.3 The ideas and opinions in these programmes and downloads are intended to be used for informational purposes only. The courses, programmes and materials are provided on the basis that the author and promoter is not rendering medical advice of any kind, and that the information is not intended to replace medical advice or to be used to diagnose, prescribe or treat any disease, medical condition, illness or injury. Events are held at rural properties and as such students are required to conduct themselves in a manner conducive to the safety of themselves and their colleagues, abiding by health and safety guidance.
11.6 Deliciously Raw will not be responsible for any damages or losses resulting from any correspondence or business dealings with third-party advertisers or recommended services or resulting from the presence of such advertisers and recommended services on the website, associated websites and forums or at events.
12. GOVERNING LAW AND JURISDICTION
12.1 These terms and conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts.
12.2 We do not warrant that materials/items for sale on the Website are appropriate or available for use outside the United Kingdom. It is prohibited to access the Website from territories where its contents are illegal or unlawful. If you access this Website from locations outside the United Kingdom, you do so at your own risk, and you are responsible for compliance with local laws.
13.1 You may not assign, sub-license or otherwise transfer any of your rights under these terms and conditions
13.2 If any provision of these terms and conditions is found by any court of competent jurisdiction to be invalid, the invalidity of that provision will not affect the validity of the remaining provisions which shall continue to have full force and effect.
